Being a lawyer who defends disability claims for a large corporation with deep pockets, it is quite true that we often throw money at these 'sure winner' cases because you just never know what could happen in a jury trial and those cases are really expensive.
That said, at times an organization needs to and often does take a stand on things like this. You allow one to 'go away' with a settlement then you are going to have a lot more to settle in the future. If I were USC's counsel on this I would advise taking this through to the end.
