The part about public figures is essentially correct, but the negligence part is not. You don't need negligence or even falsehood for a defamation claim in Texas or Ohio.Well, I actually meant Mom has the case. I'm more than a few years out of journalism law class but I seem to recall that there's a big difference in the libel laws between people deemed public figures and those that aren't.
Public figures have to show actual malice for libel, that is proof that McMurphy knew it was false or had a "reckless disregard" for whether it was false or not. That's Urban, Gene, and probably Grimes too...
Private individuals--and I'd say Grimes' mom is one--just have to show that McMurphy showed "negligence" in considering or confirming that a statement is false prior to publication.
Once again, it's been a few years...but I was a reporter for 17 years and I never got sued once. I give the First Amendment all of the credit for that, by the way.

He's got a lot of immaturity and not much on the other side of the ledger. He's obnoxious in a way that is not consistent with UT's self-image. I can say a lot of bad things about Mack -- and even more bad things about his brother Watson -- but Mack projected a suitable image for the university. Herman won't last.
