Well, its his Dad. I think he's estranged from the family. The article attacks the Mom, basically implies she lied about having cancer to get a medical hardship for the son. Believe me, I normally stick up for reporters but this one has a host of ethical issues including medical privacy issues, heavy use of anonymous sourcing etc.
You would also need a bunch of black OSU WRs to be lying about it now as Johnny Dixon, Parris Campbell etc. are coming out and saying it's not true. This one doesn't ring true to me. Just my .02 cents.
 
I was curious on the family background. I guess we'll let it play out and see what each side comes up with.

Well, I actually meant Mom has the case. I'm more than a few years out of journalism law class but I seem to recall that there's a big difference in the libel laws between people deemed public figures and those that aren't.
Public figures have to show actual malice for libel, that is proof that McMurphy knew it was false or had a "reckless disregard" for whether it was false or not. That's Urban, Gene, and probably Grimes too...
Private individuals--and I'd say Grimes' mom is one--just have to show that McMurphy showed "negligence" in considering or confirming that a statement is false prior to publication.

Once again, it's been a few years...but I was a reporter for 17 years and I never got sued once. I give the First Amendment all of the credit for that, by the way.

He obviously has a compulsive agenda against Ohio State. Clearly no reason to believe in a racist altercation with Grimes. Hearsay or multiple eye witnesses....
 
Bye bye Brett. Worst piece of journalism I've seen in sports for a long time. It's obvious this man has an agenda against tosu. This story has no proof, and players to back it up that were there including the player in question who has been liking tweets on social media that defend urban and Smith.

I can't say I'm impressed with Tom Herman in any way, shape, or form regardless of whether these claims are true. He is not UT material.

The part about public figures is essentially correct, but the negligence part is not. You don't need negligence or even falsehood for a defamation claim in Texas or Ohio.
 
UT is about winning. Herman got that winning swagger. This is an entertainment business, not some moral compass, some beacon of higher education.

He's got a lot of immaturity and not much on the other side of the ledger. He's obnoxious in a way that is not consistent with UT's self-image. I can say a lot of bad things about Mack -- and even more bad things about his brother Watson -- but Mack projected a suitable image for the university. Herman won't last.

In Texas and Ohio (unlike Georgia) the defendant has to prove he's telling the truth rather than vice versa.

They definitely care about their image, and they aren't much more relevant now than they were last year.
 
The thing about NYT v. Sullivan was that it (supposedly) applied the First Amendment to limit what states could do with defamation law. But otherwise the 50 states are going to vary as much as they do on anything else.
